You consent to the transfer of your personal information to the United States in order to receive services from US Performance Academy or a US Performance Academy affiliated school. We collect personally identifiable information you provide voluntarily when requesting information, catalogs, or other materials or to satisfy other requests. If you decide to enroll your child in our program, we collect information from you during the application and enrollment process such as certain education records, date of birth, and proof of residency.
We may collect personal information at other times including when you email us, complete surveys, or otherwise communicate with us.

Non-Personally Identifiable Information
Because non-personally identifiable information does not identify you, we reserve the right to use it for any lawful purpose and to share it with third parties for any lawful purpose. Please note that to the extent any non-personally identifiable information is combined with personally identifiable information, the combined information will be treated as personally identifiable information for as long as it is so combined.
Student Data Privacy
US Performance Academy, Inc. is an education company that provides various management, content and education services (“Services”) to our customers, including partner organizations and athletic programs that wish to provide students and their families with an exceptional online school option.
US Performance Academy uses industry best practices to protect the privacy of all of our students and families. When our Services are used as part of a partner organization’s educational mission or a family enrolls their student with US Performance Academy, the personal information related to the student users (“School Users”) that is (i) provided to US Performance Academy by a parent, student or partner organization, or (ii) collected by US Performance Academy during the provision of our services to a student or Partner Organization, may include information protected by similar student data privacy laws. We call this information “Student Records.”
We do not disclose Student Records for targeted advertising purposes. We do use certain marketing technologies for the purpose of retargeting, analytics and attribution activities.
We do not build a personal profile of a School User other than in furtherance of an educational purpose or as authorized by a Guardian.
We will never sell Student Records.
Privacy in Online Classes and Meetings
Many of our students participate in classes and tutorials via Zoom and/or Pronto and use online chat and messaging as part of their educational experience at US Performance Academy. Any information that students share during a class or tutorial, or in any online chat, message board or discussion room, is available to all other individuals who have access to the class and/or chat/message board/discussion room. Therefore, US Performance Academy cannot guarantee the privacy of the information that students provide in these situations.
Children may not provide personally identifiable information without providing prior parental consent or parental notification, which will include an opportunity for the parent to prevent the use of the information and participation in the activity.
Children may not publicly post or otherwise distribute personally identifiable contact information without prior parental consent.
How We Share and Disclose Student Records
Depending on the features and account controls applicable to the School User accounts, we may share usernames and account information with other users, such as teachers, learning coaches, athletic coaches or school administrators. In the US Performance Academy Student Information Systems and Learning Management Systems, access to student information and data is controlled by a central team of administrators.. Only administrative users who have appropriate permissions will be able to access student data. Data points and reports will be assigned to roles, including vendors with whom US Performance Academy has contracted to provide a service. Access to reports and all student data will be controlled by these roles. Only users with the correct roles will meet the requirements to access student data.
The student information systems and learning management system contain personally identifiable information that is maintained and accessible by third parties (such as service providers, content partners or vendors). These third parties are provided access to the minimum amount of information required to allow them to perform the tasks for which they have been engaged or contracted. Such third parties have agreed to maintain the confidentiality of such information and to use or disclose it only for the work they are performing for us, or as permitted by law.
Third parties who have access to user data include, but are not limited to:

– Zoom Video Communications, Inc.
– Blackbaud, Inc.
– Mailchimp (The Rocket Science Group, LLC), which we use to manage email
lists, send emails and analyze performance of emails sent to our users.
By enrolling in USPA you are agreeing to your child’s information being shared with the abovementioned third parties and any others that may be added during the academic year.
Children Under the Age of 13
The Children’s Online Privacy Protection Act of 1998 and its rules (collectively, “COPPA”) require us to inform parents and legal guardians (as used in this section, “parents”) about our practices for collecting, using, and disclosing personal information from children under the age of 13 (“children”). It also requires us to obtain verifiable consent from a child’s parent for certain collection, use, and disclosure of the child’s personal information.
The Websites are not intended to solicit information of any kind from children under the age of 13, and we do not and will not knowingly contact or collect personally identifiable information from children under 13. The only personal information we receive about children under the age of 13 is information provided by the parent or legal guardian or information provided by the child as part of that child’s participation in a course or courses as part of that child’s K-12 education program. By enrolling a child in such course or courses, a parent is consenting to the collection of that information.
It is possible that by fraud or deception by others we may receive information pertaining to children under the age of 13. If we are notified of the receipt of information under such circumstances, once verified, we will promptly obtain parental or guardian consent, and in the absence of such consent, will delete the information. You can request to review, edit, or prohibit personally identifiable information of a child under the age of 13 from being used by US Performance Academy, its affiliates, schools, and vendors acting on behalf of US Performance Academy by making a request in writing to email@example.com. Please note that if you make a request to prohibit personally identifiable information from being used by US Performance Academy, its affiliates, schools, and vendors acting on behalf of US Performance Academy, it will not be possible for your child to participate in a US Performance Academy program.

US Performance Academy makes commercially reasonable efforts to safeguard the personally identifiable information we collect and store. We do this, in part, by implementing account verification procedures and password protection features. As effective as our safeguards are, no security system is completely impenetrable, therefore we cannot guarantee the absolute security of our database and systems, nor can we guarantee that personally identifiable information you supply will not be intercepted while being transmitted to us over the Internet.
All data accessed via the learning management system and student information systems will be accessed through forced SSL for privacy and security purposes. Private data transmitted between systems for data reporting purposes will always be transmitted with secure FTP or over a private VPN that provides encryption.
In the event that any information under our control is compromised as a result of a breach of the security of our systems or inadvertent release of information, we will take reasonable steps to investigate the situation and provide notice of the security incident in accordance with applicable laws and regulations.
Accessing and Correcting Your Information

We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
